These Terms of Service govern your use of the Exhaven website and your purchase of our products. By using the site or placing an order, you agree to these Terms.

1. Who we are

"Exhaven," "we," "us," and "our" refer to the Exhaven brand and the people behind it. Our website is hexhaven.com. For questions, contact hello@exhaven.com.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order. By placing an order you confirm that you meet this requirement.

3. The products

Exhaven sells smart home devices designed to be open, privacy-respecting, and not dependent on cloud services. Specifications, features, designs, and pricing of our products are subject to change as we develop them. We may add features, change designs, or substitute components during development to improve the product. We will not make changes that materially diminish the product without giving you the option to cancel.

4. Reservations and pre-orders

We sell our products through several order types, each with different terms:

Free waitlist

Joining the waitlist costs nothing and creates no obligation on either side. You will receive product updates and an early notice when products are ready. We may close the waitlist at any time.

Reserved orders

A Reserved order requires a deposit. The deposit holds your place in line and is fully refundable at any time before your order ships, with no questions asked. See our Refund Policy for details.

Founder pre-orders

A Founder pre-order is a discounted pre-purchase of one or more devices that have not yet shipped. By placing a Founder order, you understand that:

5. Pricing and payment

All prices are in US dollars. We process payments through Stripe. You authorize us to charge your payment method for the amount of your order, including any applicable taxes and shipping. We may correct pricing errors at any time before shipment; if a corrected price is materially different from what you paid, you may cancel for a full refund.

6. Shipping

Shipping terms are described in our Shipping Policy. Title and risk of loss pass to you when we deliver the products to the carrier.

7. Refunds and cancellations

Our refund terms are detailed in the Refund Policy. In short: you may cancel any pre-order or reservation for a full refund before it ships. After delivery, returns are accepted within 30 days for unused products in original packaging.

9. Intellectual property

The Exhaven name, logo, website design, content, and marketing materials are owned by Exhaven. You may not copy, modify, or use them without permission, except as needed for normal personal use of the site.

Hardware components, firmware, and software we develop may include open-source elements. When open-source software is included with our products, we comply with the applicable open-source license terms and make source code available where required.

10. Warranty

When you receive a physical product, it comes with a one-year limited warranty against defects in materials and workmanship under normal use. The warranty does not cover damage from misuse, accidents, modifications, or normal wear and tear. To make a warranty claim, contact hello@exhaven.com with your order reference.

EXCEPT FOR THE LIMITED WARRANTY ABOVE, THE PRODUCTS AND SITE ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EXHAVEN'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

EXHAVEN IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, OR PROPERTY DAMAGE) ARISING OUT OF YOUR USE OF THE SITE OR PRODUCTS.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the limits above may not fully apply to you.

12. Indemnification

You agree to indemnify and hold Exhaven harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of our products or the site.

13. Termination

We may suspend or terminate your access to the site if you violate these Terms, attempt fraud, or abuse the service. We may also discontinue products, programs, or the site itself at any time. If we discontinue something you have already paid for and not received, we will refund you in full.

14. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict of law principles. Any dispute arising out of these Terms or your use of the site will be brought in the state or federal courts located in Virginia, and you consent to the jurisdiction of those courts.

Before filing a formal claim, you agree to first contact us at hello@exhaven.com to attempt to resolve the issue informally. We will do the same with any complaint we have with you.

15. Changes to these terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top. For material changes, we will notify customers with active orders by email. Continued use of the site after changes means you accept the updated Terms.

16. Severability and entire agreement

If any part of these Terms is found to be unenforceable, the rest stays in effect. These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and Cookie Policy, form the entire agreement between you and Exhaven regarding your use of the site and purchase of products.
